PAYING FOR LONG-TERM CARE
QUESTION: My Mother and Father just passed away. They have a trust and I have been appointed the trustee. It’s more complicated than I thought and my family is arguing about everything I do. I am thinking about having an attorney help me. Do I have to go to the same attorney that did the trust? Do I have to pay the attorney out of my pocket?
ANSWER: No, they are not right. I am not sure why they would tell
you that when it is clearly untrue. You Mother does not have to pay the nurs- ing home out of her own pocket until all of her assets are gone. The State of Michigan has a Medicaid program for patients of nursing homes. Under that program, your Mother is allowed to keep her home as long as the value does not exceed $560,000. She is also allowed to keep all of her household goods, all of her jewelry, and one car regardless of value. The amount of money she can keep is very limited;
it is only $2,000. However, there are planning options available to save
all or a portion of her excess money. Once she meets the asset requirements
for Medicaid, she can apply for Medicaid to pay for the nursing home.
As you can see, she may not have to sell anything. A word of caution though; there is an Estate Recovery Program in effect in Michigan. This allows the State of Michigan to take approximately one-half of the value of her home when she passes away. I would advise you to see an attorney who specializes in protecting assets when someone goes into a nursing home. There are planning options available to save some or all of her cash assets and also protect her home from the Estate Recovery Program.
